TERMS AND CONDITIONS OF USE GOVERNING THE USE OF THIS WEBSITE

These Terms and Conditions (“the Terms and Conditions”) govern your (“the User” or “you”) use of the Natural Selection Self-Investing (“the Provider” or “the Owner”) website located at the domain name www.investthetrend.com (“the website”). By visiting any page on the website or by communicating with the Owner in any format or context whatsoever, or by subscribing to services offered by the website, you agree to be bound by this Agreement. If you do not agree with any of the Terms and Conditions in this Agreement, you may not use or access the website.

The Provider provides financial, economic, political, and investment content at the website. All such content, and the compilation of the content, are copyright the Provider, and are protected by Canadian and international copyright laws. The Provider reserves the right to make any changes to the website, the content, or to products and/or services offered through the website at any time and without notice. All rights in and to the content is reserved and retained by the Owner. Except as specified in these Terms and Conditions, the User is not granted a license or any other right including without limitation under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the content. The User may not access, display, use, download, and/or otherwise copy or distribute content obtained on the website for any purpose without the consent of the Provider.

E-Commerce & Privacy

The website sells paid subscription services online. The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, and email address will be kept in the strictest confidence by the Provider and will not be sold or made known to third parties. Credit card details are not kept by the Provider under any circumstance.

The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

Access to certain features of the website may require the User to register and create an account, which involves providing an email, and choosing a username and password of your choice. The User agrees to be solely responsible for all activities conducted through his/her account, including the purchase of subscription, and for ensuring the confidentiality of personal login information. The User may not use another user’s account without written permission from the Provider.

By providing an email address to the website or Provider directly, the User consents to the Provider using the email address to send notices related to portfolio changes, blog updates, trade set-ups, additional service offers or for the purpose of general administration. The User may unsubscribe to some or all email communications at any time by emailing the Provider at contact@investthetrend.com.

Subscription Service and Refund Policy

The website offers a subscription service and Users who have a paid subscription agree not to forward or redistribute any of the subscription content, including emails, or communication in any other written or verbal form without prior written permission of the Provider. Information on the Public Blog and other free pages on the website can be distributed to other interested parties as long as information is used purely for informational purposes and the website source is provided.

Non-refundable subscriptions are available on a monthly renewable basis to give subscribers the option of cancellation each month. Yearly subscriptions are also available and are not refundable, in full or on a pro-rated basis. All payments are final. There are no exceptions. For Users who are uncertain about making a longer-term subscription commitment, but would still like to subscribe, the Provider encourages subscribing on a monthly basis. All membership types will be automatically renewed at the expiry of the current membership term. It is up to the User to notify the Provider of membership cancellation by email to contact@investthetrend.com at least three days in advance of the renewal date.

The Provider reserves the right to modify or cancel certain services offered at the website at his discretion. The User agrees that any and all changes to the service are deemed acceptable and will not alter the terms of subscription. The Provider reserves the right to cancel any User’s subscription and deny website access if the Provider deems that the User’s comments or actions are abusive and/or damaging to the commercial interests of the Provider or to other Users. No refund will be provided in such cases.

On occasion, the Provider will share subscriber content on the public blog and offer promotional options and/or discounts for new subscribers in an effort to grow the subscriber base. The User acknowledges and agrees that these promotions are for new subscribers only and that the User will not be offered retro-active discounts to reflect the promotional or discounted subscription price. In such instances, new subscribers are defined as users who have not previously subscribed to the website's services or previous subscribers who have not held a subscription during the previous six months.

Limitation of Liability

The website and all content on the website, whether free or paid for through subscription, including any past, current or future content, is provided for educational and research purposes only and should not be considered financial or investment advice of any kind. The Provider strives to present accurate information and useful content, but the composition of stock and ETF portfolios, the analysis on the blogs, the trade set-ups, the watch-lists, and all other content presented, ultimately reflect the Provider’s opinions and are provided without warranty or guarantee of any kind. Under no circumstance will the website or the Owner be held liable for any investment or trading losses, or damages incurred of any kind, resulting from any decision made or action taken by the User or any third party, based upon the content and/or opinions provided on the website or based on any communication involving the Owner in any format or context whatsoever. This communication includes but is not limited to email notifications sent from the Provider to the User regarding changes to any of the portfolios presented on the website, trade set-up discussion, or discussion of buying and selling any security.

The Owner/Provider of the website is not a registered stock broker, certified financial planner, licensed financial adviser, and does not represent himself as a qualified investment adviser. The User should be aware that investing in stock markets carries considerable risk and that trading or self-investing may not be suitable for all users of the website. The User cannot assume that profits will be realized on any of the strategies described on the website and the User further understands that any self-investing strategy can result in financial losses including the complete loss of capital. The User acknowledges and agrees that all investment and trading decisions should be made only after consulting with a qualified and certified financial planner. Finally, the User understands and agrees that the Provider may hold positions, as investments or as trades, in securities being discussed on the website or mentioned in communication with Users.

While every effort is made to ensure the accuracy of information presented on the website, the Provider makes no warranty or representation as to the availability, accuracy or completeness of the content. The Provider, shall not be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the content on the website or any functionality thereof, or of any linked website, even if the Provider is expressly advised thereof.

Online Payment

All online credit card payments are processed by Stripe Online Payments. Card Holders may go to https://stripe.com to view Stripes’s security policies. Payments can also be made through PayPal, whose security policies can be accessed at www.paypal.com. Under no circumstance will the website or the Owner be liable for any problems whatsoever (including overcharging) experienced through use of a third party payment provider. Use of third-party providers are governed by Terms and Conditions outlined on those respective websites.

Vacation Time

All Users of the website, including paid subscribers, agree that the Provider is entitled to take up to six weeks of vacation time per calendar year. Users agree that during the Providers' vacation time, regular services will be offered on a limited basis or may be unavailable altogether.

Website Shutdown

From time-to-time, the website and services offered by the Provider may experience technical challenges that cause website shut-down or prevent the delivery of service. The User agrees and acknowledges that the Provider will not be liable for any events resulting from disruptions in service of any kind and that the User is not entitled to any form of compensation or refund of subscription payments for diminished service experience.

Links to Other Websites

The website may contain links to other websites that are not operated by the Provider. If Users click on website links, they will be directed to a third party’s website. The Provider assumes no responsibility and is not liable for the content, privacy policies or accuracy of information presented on any third-party websites.

Tracking and Cookies Data

The User may visit the website without providing any personal information. The website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information, unless it is voluntarily provided. The User understands that the website uses cookies and similar tracking technologies to track the activity on the website. Cookies are small files that contain data, which may include an anonymous unique identifier. They are used by websites to track the number of visitors and gain insight regarding how visitors use the website. This information allows the Provider to offer content in a way that can best ensure that visitors have the best possible experience when using the website. Updating of these Terms and Conditions

The Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to the website. It is the User’s obligation to periodically check these Terms and Conditions at the website for changes or updates. The User’s continued use of the website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Choice of Law

The website is controlled, operated and administered by the Provider who is a citizen of Canada. The User may not use the website in violation of Canadian laws and regulations. If the User accesses the Website from locations outside of Canada, that User is responsible for compliance with all local laws. These Terms and Conditions shall be governed by the laws of the country of Canada, and the User consents to Canada being the jurisdiction in which any dispute resolution will occur. If any of the provisions of these Terms and Conditions are found by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions, and the remainder of these Terms and Conditions shall continue in full force and effect. These Terms and Conditions constitute the entire agreement between the Provider and the User with regard to the use of the Website, it’s content, and any communication between the User and the Provider.
